The service

MakingWaves identifies tracks you play, builds a timestamped tracklist, masters recorded mixes, and (with your permission) publishes them to Mixcloud, Hearthis, and YouTube. We provide it as-is. We aim for high availability but don't promise specific uptime numbers in v1.

Your responsibilities

Billing

Account suspension

We can suspend or close accounts that breach these terms. We'll tell you what triggered it before doing anything irreversible, except in cases of fraud or active abuse.

Liability

We're not liable for indirect damages, lost income, or platform takedowns — Mixcloud / Hearthis / YouTube make their own decisions about what they'll host. Our total liability for any claim is capped at the fees you paid us in the previous 12 months.

Changes

We may update these terms; meaningful changes will be emailed before they take effect. Continuing to use the service after the change date counts as acceptance.

Governing law and disputes

These terms are governed by the laws of England and Wales. Any dispute that can't be resolved by email goes to the courts of England and Wales. Nothing in these terms limits your statutory rights as a consumer.

Force majeure

We're not liable for service interruption caused by events outside our reasonable control - upstream provider outages (Mixcloud / YouTube / Stripe / our hosting), denial-of-service attacks, internet failures at your location, or acts of nature.
